PHOTOGRAPHY POLICY

BOOKING FEE
There is a $50 non-refundable booking fee that is required of all clients to reserve the date/time of the photo session.

CANCELLATION/RESCHEDULES
Cancellations must be made 24 hours before the photo session. 1 emergency cancellation is allowed within the 24 hours of photo session. After that, another deposit is required and reschedule date is based on Photographer’s availability. No money will be refunded for a No Call/No Show. If the Photographer reschedules due conflict or emergency, a refund will be given.

CLIENT’S USAGE
The Client is obtaining prints for personal use only and shall not sell prints or authorize any reproductions thereof by parties other than the Photographer. Any photographs taken may be used for personal use and cannot be sold for profit. Original photographs (RAW files) are not included.

COPYRIGHT
The Photographer (Artistik Rebel Creative) holds and reserves all rights pertaining to copyright. Notice of Copyright: It is ILLEGAL to copy, reproduce, or profit from these photographs or videos elsewhere without Studio/Photographer’s permission and violators of this Federal Law shall be subjected to its civil and criminal penalties.

FORMS OF PAYMENT
Card payments are made through the booking website: https://book.artistikrebel.com. Other acceptable forms of payment must be agreed upon prior to photo session.

LATE PAYMENTS
The session fee is due at the beginning of the session or earlier. Payments not paid in full by the beginning of the session are considered late and will result in the proofs/products being withheld until payment is made in full.

LIMITATION OF LIABILITY
Although great care will be taken with the images, this contract limits the entire liability for any claim, loss, injury or failure to deliver images to the return of any fees paid by the client under this contract. In the unlikely event of personal illness or other circumstances beyond the control of Artistik Rebel Creative, an attempt will be made to procure the services of another professional photographer to fulfill the obligations of Artistik Rebel Creative. Artistik Rebel Creative is not responsible or liable for any other damages beyond the amount of this contract. The client agrees to indemnify, defend and hold Artistik Rebel Creative and their representatives, agents, contractors, employees, successors and assigns, harmless for any and all liabilities, damages, claims, suits, judgments, costs, fees and expenses that arise as a result of or in connection with the services provided.

LIABILITY RELEASE RELATED TO PHOTOGRAPHY SESSION
Client acknowledges that modeling can, in some circumstances, be dangerous. The Client acknowledges that the Client and any minor children of the Client are not obligated to perform any act the Client deems dangerous or otherwise inappropriate. The Client agrees to let the Photographer know if the Client does not wish the Client or the Client’s minor children to perform or participate in any act, including, but not limited to: the use of props or positioning in certain poses requested by the Photographer. While all reasonable precautions will be made to ensure the safety of any photography model, Client acknowledges that accidents may occur. Client hereby agrees to indemnify and hold harmless the Photographer (including the Photographer’s employees, agents, or business associates), from any injuries, damages, or other losses that may occur directly or indirectly as a result the Photography Session.

MODEL RELEASE
The Photographer (Artistik Rebel Creative) has the right to use the photographs in all forms and in all media and in all manners, without restrictions to alterations for advertising, trade, promotion, and exhibition. Images remain the property of The Photographer (Artistik Rebel Creative) and the client waives all rights to approve the photographs.

PERMITS (FOR ON LOCATION PHOTO SHOOTS)
The City of Houston has become stricter on professional photography at some public parks/venues and there is a possibility a permit is required to photograph. The price varies for securing a permit and is separate from the session fee.

PHOTO ARCHIVE FEE
Photos will remain online in private photo gallery for 90 days after the portrait session. After 90 days the photos will be archived and an archival fee will be charged to repost digital album downloads.

PHOTO CONSULTATION
Each photo session has its own identity and the main goal of the photo shoot is to make sure you were satisfied. In order for that to take place, there has to be mutual interest in what’s going on. I’m saying this to see what ideas you may have and what your vision for the photo shoot is.

PHOTO EDITING/RETOUCHING
Photographs are edited to cover lighting and technical camera issues. Photo retouching is in place to remove minor blemishes and even skin tone. If you require detailed retouching such as for excessive acne, teeth whitening, or cosmetic purposes; the fee varies. Turnaround time for retouched portraits varies per image.

PHOTO SESSION: ADDITIONAL PEOPLE
No more than 1 person is allowed during the photo session. Time/space is limited and additional people can be a distraction while photographing.

POST PRODUCTION: PROOFS
After the photo shoot, online proofs of the images will be available via web within 7 days. You will be sent via text and/or email a link to access your private online gallery to make your final selections to edit. Proofs will have minor editing. Do not share/post the unedited proofs on social media or on the internet. Doing so is a direct violation of the contract and may result in legal action.

POST PRODUCTION: EDITING/TURNAROUND TIME
There is a 2-3 week turnaround time for editing once you make your selections from online proofs. Please be aware of processing times when booking your photo session. Rush orders are not available.

POST PRODUCTION: FINAL EDITS/DELIVERY
Your final selections will be submitted via digital download and/or electronically via .zip files. You have the option to purchase prints, products, and or licenses at an additional cost.

SESSION FEE/RE-SHOOT
The session fee is for the service of taking photos only. Please note: Your session fee does not come with any digital images. Digital images, prints and other products are priced separately from the session fee. The session fee is due at the beginning of the session or earlier. If there are no technical errors (i.e. camera malfunction) and you are not satisfied with your proofs, 1 re-shoot will be scheduled at a reduced rate.

TIME ALLOTMENT
Please arrive on time and ready to begin your session. The time quoted includes time for changing outfits, re-applying makeup, and any other client specific needs. Keep hair/makeup appointments and traffic in mind before scheduling your photo session. Session will be cancelled if more than 30 minutes late.

WEATHER CONDITIONS
If, in the opinion of photographer, inclement weather or other adverse conditions prevent the photo session, the photographer may elect to use an alternative location or reschedule the session at no additional cost to the client.

GUESTS ESTIMATES
The client will provide Artistik Rebel Creative with an estimated number of guests expected to attend. If the estimate differs significantly from the actual guests that attend, Artistik Rebel Creative reserves the right to adjust the price on the final bill accordingly.

GUESTS/SHOT LIST
In order to help achieve the best results possible at events, either the client or their designee must point out individuals/groups that are important to have photographed. It is the client’s responsibility to ensure that key individuals are on time, available, and prepared to be photographed. The client will provide Artistik Rebel Creative with a list of suggested photographs that they desire in advance. While every attempt is made to accommodate the client’s desired list of photographs and create the best images possible, no particular image is guaranteed.

EVENT EXCEPTIONS
Artistik Rebel Creative is equipped to handle most low-light situations. In situations where flash photography is prohibited or is deemed to be unsafe, the client agrees to accept the images as-is, given the technical limitations of low-light photography.

COPYRIGHT/ LICENSE TO USE
It is understood that Artistik Rebel Creative owns the copyright to all of the images and reserves the right to use them for display, publication, advertising or other purposes. Upon receipt of final payment, the client is granted a Non-Exclusive Unlimited License to use the images for their own non-commercial purposes, such as printing, electronic messaging, exchange with friends and relatives, or display on the internet. No images will be provided to the client until full payment has been made.

DEPOSIT, RESERVATION AND SCHEDULING
For events, a non-refundable retainer totaling 50% of the agreed upon amount is due upon signature of this agreement. The balance is due by the day before the event. Any overtime fees approved verbally by the client during the event are due upon completion of the event. All deposits are non-refundable.

OTHER SERVICES
This contract is for the photography services and electronic delivery of the Licensed Digital Images only. Additional services, such as providing high resolution digital images on physical media, touch-ups, or editing are available as a separate order.
